cURL Error #:HTTP/2 stream 1 was not closed cleanly: PROTOCOL_ERROR (err 1){"id":51455,"date":"2023-12-20T17:55:34","date_gmt":"2023-12-20T22:55:34","guid":{"rendered":"https:\/\/www.longisland-ny.com\/2023\/12\/20\/federal-court-blocks-biden-admin-from-removing-texas-border-barrier\/"},"modified":"2023-12-20T17:55:34","modified_gmt":"2023-12-20T22:55:34","slug":"federal-court-blocks-biden-admin-from-removing-texas-border-barrier","status":"publish","type":"post","link":"https:\/\/www.longisland-ny.com\/2023\/12\/20\/federal-court-blocks-biden-admin-from-removing-texas-border-barrier\/","title":{"rendered":"Federal Court Blocks Biden Admin from Removing Texas Border Barrier"},"content":{"rendered":"<p><\/p>\n<div id=\"\">\n<p>Texas has won a round in its court battle to keep Biden administration officials from cutting through barbed wire the state has placed along the Rio Grande to keep out illegal immigrants.<\/p>\n<p>The state had appealed a lower court ruling issued in November letting federal agents cut the wire to allow illegal aliens into Texas, <a href=\"https:\/\/www.nytimes.com\/2023\/12\/19\/us\/texas-border-wire-biden-administration.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported.<\/p>\n<p>\u201cThe federal government has not only illegally destroyed property owned by the State of Texas; it has also disrupted the State\u2019s border security efforts, leaving gaps in Texas\u2019s border barriers and damaging Texas\u2019s ability to effectively deter illegal entry into its territory,\u201d the state had argued, according to <a href=\"https:\/\/www.foxnews.com\/politics\/federal-appeals-court-blocks-biden-admin-from-removing-texas-razor-wire-at-southern-border\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.<\/p>\n<p>Fox noted that border officials encountered a record <a href=\"https:\/\/www.westernjournal.com\/single-day-illegal-immigrant-record-shattered-bidens-border-crisis-gets-even-worse-report\/\" target=\"_blank\" rel=\"noopener\">12,600 migrants<\/a> at the southern border on Monday.<\/p>\n<p>The U.S. Court of Appeals for the Fifth Circuit issued an <a href=\"https:\/\/s3.documentcloud.org\/documents\/24233242\/5th-circuit-texas-vs-dhs-121923.pdf\" target=\"_blank\" rel=\"noopener\">injunction<\/a> against the federal government on Tuesday, ruling that while Texas\u2019 appeal is in process, the wire it has strung can only be cut if there is a medical emergency.<\/p>\n<div id=\"in-article-trending\" class=\"in-article-more inner-content\">\n<p>Trending:<\/p>\n<div class=\"in-article-more-right\">\n<a href=\"https:\/\/www.westernjournal.com\/total-fail-lt-gov-calls-trumps-removal-california-ballot-gets-presidential-age-requirement-wrong\/\" data-type=\"Internal link\" data-type-location=\"in-content-trending\">Total Fail: Lt Gov Calls for Trump&#8217;s Removal from California Ballot, Gets Presidential Age Requirement Wrong<\/a>\n<\/div>\n<\/div>\n<p>While the federal government said <a href=\"https:\/\/www.westernjournal.com\/following-colorado-ruling-texas-lt-gov-suggests-biden-taken-off-states-ballot\/\" target=\"_blank\" rel=\"noopener\">Texas<\/a> is interfering in immigration, a federal issue, the court did not agree, instead siding with Texas\u2019 argument that the Biden administration should keep its\u00a0hands off state property.<\/p>\n<p>\u201cThe district court found that the Border Patrol exceeded its authority by cutting Texas\u2019s c-wire fence for purposes other than a medical emergency, inspection, or detention. Moreover, the public interest supports clear protections for property rights from government intrusion and control,\u201d the appeals court said.<\/p>\n<p>The court said the injunction was necessary to protect Texas from the harm it would suffer if the Biden administration were allowed to continue cutting its wire as the case moves through the courts.<\/p>\n<p>\u201cThe district court found Texas would suffer irreparable harm \u2018in the form of loss of control and use of its private property.\u2019 We see no error, clear or otherwise, in this finding,\u201d the appeals court wrote.<\/p>\n<div id=\"firefly-poll-container\" class=\"one-half\" wp_automatic_readability=\"6.354609929078\">\n<p>Should a wall be built across the entire southern border?<\/p>\n<div id=\"firefly-poll-results\" style=\"display: none;\">\n<p>\nYes: 100% (105 Votes)\n<\/p>\n<p>\nNo: 0% (0 Votes)\n<\/p>\n<\/div>\n<\/div>\n<p>The 29 miles of wire strung along the border is part of a multi-phase effort by the state to deter illegal immigration, which Gov. Greg Abbott has said is necessary because of the <a href=\"https:\/\/www.westernjournal.com\/texas-democrat-says-cant-go-store-church-without-hearing-bidens-border-failure\/\" target=\"_blank\" rel=\"noopener\">open-border policies<\/a> of President Joe Biden.<\/p>\n<p>Earlier this week, Abbott <a href=\"https:\/\/www.westernjournal.com\/greg-abbott-throws-gauntlet-signs-bill-letting-police-arrest-illegal-immigrants\/\" target=\"_blank\" rel=\"noopener\">signed a law<\/a> that makes crossing the border illegally a state crime. The law would jail illegal immigrants unless they agree to immediately go back to Mexico, <a href=\"https:\/\/www.texastribune.org\/2023\/12\/18\/texas-governor-abbott-bills-border-wall-illegal-entry-crime-sb3-sb4\/\" target=\"_blank\" rel=\"noopener\">The Texas Tribune<\/a> reported.<\/p>\n<p>\u201cBiden\u2019s deliberate inaction has left Texas to fend for itself,\u201d Abbott said on Monday.<\/p>\n<hr\/>\n<div class=\"author_subscription_pitch\" wp_automatic_readability=\"47.801814375436\">\n<p><em><span style=\"font-weight: 400;\">Did you know that publishers everywhere are laying people off at Christmas?
