Robert F. Kennedy Jr. has threatened to take legal action against the Department of Homeland Security (DHS) after being denied secret service protection for the fifth time.

Department Secretary Alejandro Mayorkas concluded that Kennedy does not require Secret Service protection, in a letter to the Kennedy campaign dated March 28th. This decision was made after conferring with an advisory committee that included the Senate Sergeant at Arms and prominent members of Congress.

Kennedy’s lawyer, Aaron Siri, responded to Mayorkas’ series of denials in a letter on March 29th, which was posted to X, labeling them “capricious, an abuse of discretion, and clearly politically motivated.”

In the letter, Mayorkas and the DHS are accused of “ignoring the real risks” to Kennedy, citing an instance at a campaign event that involved a guest carrying two loaded handguns.

The Secret Service has extended protection to presidential and vice-presidential candidates since the 1968 assassination of Kennedy’s father and then-Democratic presidential candidate, Robert F. Kennedy.

Kennedy Jr. is also the nephew of the late President John F. Kennedy, who was killed in office earlier that decade.

According to the Secret Service website, requirements for protection include declaring oneself in public, being the target of “general or specific threats” and, in the case of independent and third-party candidates, polling at 20% or higher in the Real Clear Politics national average for a minimum of 30 days.

Kennedy’s national average for Real Clear Polling as of Thursday was approximately 11%.

According to the website, the DHS Secretary likewise has “broad discretion” in choosing which applicants meet the requirements.

Given that Kennedy was running against President Joe Biden, Siri accused Mayorkas of refusing to provide protection and vowed to hold the secretary personally responsible if the candidate suffered harm.

Department of Homeland Security Secretary Alejandro Mayorkas has stated that they were not notified about the previous arrests of the suspect in the killing of nursing student Laken Riley.

On Sunday, Mayorkas stated that the federal government was not notified about previous arrests by Jose Ibarra in the murder of Riley.

“Different cities have different levels of cooperation,” Mayorkas said. “We were not notified in this instance.”

Ibarra was detained by border patrol in September 2022 after entering the nation illegally from Venezuela, according to information released by U.S. Immigration and Customs Enforcement (ICE) on Monday. 

They also stated that he was “set free while his case was investigated.” According to ICE, he was detained once more in August 2023 in New York, where he was accused of violating his driver’s license and acting in a way that could cause harm to a child under the age of 17. 

It is reported that before ICE could place him under arrest, he was freed by New York authorities.

In order “to ensure that individuals who pose a threat to public safety are indeed our highest priority for detention and removal,” Mayorkas stated that the federal government maintains close ties with state and local law enforcement. Nonetheless, it is evident from his remarks that different places have “varying degrees of cooperation with immigration authorities.”

“We firmly believe that if a city is aware of an individual who poses a threat to public safety, then we would request that they provide us with that information so that we can ensure that that individual is detained if the facts are warrant,” Mayorkas said.

Riley, a nursing student at the Augusta University College of Nursing, was reported missing last week by her roommate after she failed to return home after a run, which was untypical of her. Soon after, officials extensively searched for the missing student and later found her “not breathing,” with “visible injuries” in a forested area near Lake Herrick.

She was pronounced dead at the scene.

The White House has expressed their condolences to the victim’s family and referred all questions about the case to law enforcement and ICE.

Republicans overcame strong Democrat resistance to proceed with their accusations, and Alejandro N. Mayorkas, the U.S. homeland security secretary, became the first member of the sitting cabinet to be impeached.

In a vote that broke all previous records, the U.S. House of Representatives decided on Tuesday to remove Homeland Security Secretary Mayorkas from office.

Mayorkas was accused of deliberately failing to enforce border rules and betraying public confidence.

By a vote of 214-to-213, Republicans triumphed over Democrat members’ resistance and internal dissent to impeach Mayorkas.

Republicans cheered as the vote was gaveled out. GOP Representative Marjorie Taylor Greene (R-Ga.), a driving force behind the impeachment, was seen posing in photos with members while receiving hugs and congratulations.

Prior to the vote’s announcement, a Democrat yelled, “Shame!” aloud.

Republican Steve Scalise (R-La.), whose return to D.C. helped Republicans push the impeachment process to the finish line, was also embraced and fist-bumped by other Republicans.

Every Democrat had voted “No.”

In a recent letter, House Speaker Mike Johnson declared that the House will soon vote to impeach Homeland Security Secretary Alejandro Mayorkas and warned that the emerging border deal is “dead on arrival” in his chamber if it looks anything like what has already been reported.

However, negotiators caution that the package leaks have not been reliable.

Johnson’s (R-La.) warning on Friday highlights the huge obstacle that senators must overcome in order to adopt a significant national security package that includes funding for both Israel and Ukraine, even if the Senate accord has not yet been made public.

Despite the fact that HR 2, the House GOP’s immigration measure, has “little chance of passing,” Johnson reaffirmed the demands for its passage.

“I wanted to provide a brief update regarding the supplemental and the border since the Senate appears unable to reach any agreement. If rumors about the contents of the draft proposal are true, it would have been dead on arrival in the House anyway,” Johnson wrote.

Johnson announced that the articles of impeachment against Mayorkas will be considered by the House Homeland Security Committee next week and that “a vote on the floor will be held as soon as possible thereafter.”

Johnson’s action comes as former President Donald Trump has re-entered the immigration debate on Capitol Hill and as Johnson has continued to urge President Joe Biden to utilize his executive authority to enforce stricter border security measures.

“Many of our constituents have asked an important question ‘what is the point of negotiating new laws with an administration that will not enforce the laws already on the books?” Johnson wrote. “If President Biden wants us to believe he is serious about protecting our national sovereignty, he needs to demonstrate his good faith by taking immediate actions to secure it. He should sign an order right now to end the mass release of illegals and dangerous persons into our country.”

The statement was made in response to Senate leaders’ suggestion that the measure text would be made public as early as next week. It also draws attention to a significant divide between the House Speaker and Senate Minority Leader Mitch McConnell, who has spent the past six months arguing that the GOP should better support Ukraine in its ongoing conflict with Russia.

45th President Donald Trump responded to the news.

“A Border Deal now would be another Gift to the Radical Left Democrats. They need it politically, but don’t care about our Border,” Trump said in a statement on Thursday. “What is currently being worked on in the Senate will be meaningless in terms of Border Security and Closure.”

“If you want to have a really Secure Border, your ONLY HOPE is to vote for TRUMP2024,” he added.

Leaders in the Senate claim that the bill’s text with the terms of the developing agreement is almost ready to be released by border negotiators. This will be a crucial test to determine if the deal can secure the necessary GOP votes to pass.

“Soon. Hopefully soon,” said Republican Whip John Thune (R-S.D.) after being asked when the text would be released.

As of last week, discussions had not yet reached a consensus on how to finance measures aimed at increasing deterrents for illegal migrants and asylum seekers and expanding the authority of the administration to expel them. The GOP leadership also stated that much more is needed to be done to resolve the parole problem, which has continued to be a major source of disagreement in the negotiations.

Additionally, beyond reaching an agreement, there is a crucial concern regarding whether the measure can muster a sufficient coalition of Republican votes in the Senate to exert pressure on the House to act and undo what seems to be a hardening stance by that chamber’s leaders.

Meanwhile, House Republicans are pressing to remove Mayorkas from office.

Mayorkas was a key player in the bipartisan border negotiations on Capitol Hill, but at the time, he was only there to simply offer technical assistance, according to insider sources who spoke to the press.

The House Homeland Security Committee will begin debating articles of impeachment against Mayorkas next week. Johnson expressed his desire to proceed straight to floor action after the committee votes in the letter.

The White House has pushed back against Republicans efforts to impeach Homeland Security Secretary Alejandro Mayorkas.

In a memo released on Thursday, White House Oversight Spokesperson Ian Sams stated that the push to impeach Mayorkas is a “stunt” and shows blatant disregard for the constitution.

Sams also claimed that Mayorkas is actively working to find solutions to a problem he says congressional Republicans have spent years refusing to solve.

His comments came while the House Homeland Security was holding its second and final hearing on impeaching the secretary.

Representative Mark Green (R-Tenn.), Chairman of the House Homeland Security Committee, spoke at the meeting. He highlighted how Secretary Mayorkas refuses to enforce the law.  

“As we learned in last week’s hearing, as many as 85% of illegal aliens are currently being released on Secretary Mayorkas’s watch,” he said. “The secretary himself admitted this during a trip to Eagle Pass just this week.”

The committee plans to vote on an impeachment resolution on January 31st.

House Republicans have sparked debate on if they should impeach Attorney General Merrick Garland after Speaker Kevin McCarthy suggested focusing on him rather than other Biden officials.

The House GOP has been focused on the possible impeachment of Homeland Security Alejandro Mayorkas or President Biden. Despite this, McCarthy (R-Calif.) encouraged that the focus be shifted towards Garland, an official who is often criticized by the GOP.

McCarthy first mentioned the move in a tweet last month highlighting the testimony of an IRS whistleblower, who alleged that the Hunter Biden investigation was mismanaged, claiming it could serve as a “significant part of a larger impeachment inquiry.” 

“We need to get to the facts, and that includes reconciling these clear disparities. U.S. Attorney David Weiss must provide answers to the House Judiciary Committee,” said House Speaker Kevin McCarthy in a tweet on Sunday. “If the whistleblowers’ allegations are true, this will be a significant part of a larger impeachment inquiry into Merrick Garland’s weaponization of (the Department of Justice).”

Not all members of the House GOP are on board with McCarthy. Rep. Darrell Issa (R-Calif.) said that it is up to the president to remove those who aren’t following orders or carrying out their jobs, with congress stepping in only if the president fails to do so. 

Some Republicans who authored more than a dozen impeachment resolutions were surprised that the officials the documents targeted have not taken center stage.

“I was one of the original co-sponsors of the Secretary Blinken impeachment,” Rep. Andy Harris (R-Md.) said. “We ought to take that up first for the incredibly, horribly done withdrawal from Afghanistan.”

McCarhty doubled down on his stance against Garland last week in a Fox News op-ed.

“When a prosecutor shields his boss’s son from investigators, it smells like a cover-up. Garland’s DOJ did not aggressively follow the money. Why? Are they afraid where that trail ends?” he said. 

“Clearly, someone is not telling the truth, and Congress has a duty to get answers,” McCarthy continued.

Rep. Jim Jordan (R-Ohio), chairman of the House Judiciary Committee backed McCarthy’s idea, offering stronger support for targeting Garland rather than other Biden officials.

“I think he sees the facts now,” Jordan said of McCarthy. “So it’s quickly [becoming] who are you going to believe? … I’m with the speaker on we need to get to the facts. And if it warrants moving forward with an inquiry we got to do that.”

“That’ll be a decision that in the end will be made by the entire conference,” he added.

Until McCarthy’s comments regarding Garland, Mayorkas seemed like the likeliest target of a House GOP impeachment of a member of Biden’s Cabinet. Republicans have pushed to impeach Garland for almost two years over his policies at the U.S.-Mexico Border. 

The conflict of interest could be a struggle for McCarthy and Jordan.

“I think the chairman of Judiciary has a cat-herding issue that he’s got to deal with, probably,” said Rep. Dan Bishop (R-N.C.), who serves on the panel and the House Homeland Security Committee, which plans to forward its oversight report on Mayorkas for use by Judiciary.

“I will say that I have a less fully formed case in my head in all its particulars about Merrick Garland than I do about the others,” Bishop added.

House Republicans held a conference meeting on Thursday morning. There, updates were given on investigatory efforts into the Biden family. According to lawmakers, McCarthy urged Republicans to follow the evidence.

The Department of Homeland Security (DHS) has announced a new body-worn camera policy for all law enforcement agencies under its umbrella, including U.S. Customs and Border Protection, the U.S. Secret Service, and Federal Protective Service.

Alejandro Mayorkas, the Homeland Security Secretary, explained that under the new policy, all law enforcement officers and agents that will required to wear the cameras will go through an “implementation phase” while the department works with Congress to secure funding to equip all agents nationwide.

“As defined by Agency policy, in all appropriate circumstances when [law enforcement officers] are conducting patrol or are otherwise engaged with the public in response to emergency calls,” the policy said. “During a pre-planned attempt to serve an arrest warrant or other pre planned arrest, including the apprehension of fugitives sought on state and local warrants; or, during the execution of a search or seizure warrant or order.”

According to the new policy, all DHS agencies would be required to “develop, or update, policies to address the content of this policy within 180 calendar days of this policy’s implementation.”

As of right now, 7,000 cameras have been issued to agents with the U.S. Customs and Border Protection since 2021. Immigration and Customs Enforcement is currently also going through a pilot program for familiarity with the cameras.

Mayorkas said that the purpose of the new policy was to secure the “public trust” and to do that agents need to be accountable, transparent, and effective.

“Our ability to secure the homeland rests on public trust, which is built through accountability, transparency, and effectiveness in our law enforcement practices,” said Mayorkas. “Today’s policy announcement is designed to advance these essential values. Requiring the use of body-worn cameras by our law enforcement officers and agents is another important step DHS is making to bring our law enforcement workforce to the forefront of innovation, and to further build public trust and confidence in the thousands of dedicated and professional law enforcement officers at DHS.”

A department official told ABC News under anonymity that the policy will most likely not apply to Secret Service that are located on the White House Grounds.

“We had to come to the right balance,” the agency official said.

There are currently around 80,000 law enforcement officers that fall under the DHS umbrella, which is the largest agency in the federal government.

After Title 42 was lifted on Thursday, the Biden administration have said that they have implemented “sweeping new policies” which are designed to restrict access into the United States.

Secretary of Homeland Security Alejandro Mayorkas, said that 24,000 Border Patrol agents and officers have recently been reassigned to the border to help enforce U.S. laws.

“The border is not open,” he said on Thursday. “Starting tonight, people who arrive at the border without using a lawful pathway will be presumed ineligible for asylum. We are ready to humanely process and remove people without a legal basis to remain in the US.”

“People who do not use available lawful pathways to enter the U.S. now face tougher consequences, including a minimum five-year ban on re-entry and potential criminal prosecution,” the secretary added. “Together with our partners throughout the federal government and Western Hemisphere, we are prepared for this transition.”

Earlier on Thursday, Mayorkas warned that the U.S. should expect to see a rise in the number of encounters along the border due to the ending of Title 42, however, he said that they are prepared and that their “plan will deliver results.”

“We expected to see large numbers of encounters initially. We are already seeing high numbers of encounters in certain sectors,” Mayorkas said. “This places an incredible strain on our personnel, our facilities and our communities with whom we partner closely. We prepared for this moment for almost two years and our plan will deliver results. It will take time for those results to be fully realized, and it is essential that we all take this into account.”

Mayorkas made an appearance on CNN on Friday morning and said that they are “screening and vetting” to see who is eligible to remain in the country.

“We are taking them into our custody, we are screening and vetting them,” he said. “And if they do not have a basis to remain, we will remove them very swiftly.”

The State Department announced that when Title 42 is lifted, the administration would return to using Title 8.

“Like many other COVID-era public health measures,” the State Department previously said in April. “The CDC’s temporary Title 42 public health order will also come to an end. But the lifting of the Title 42 order does not mean the border is open. When the Title 42 order lifts at 11:59 PM on May 11, the United States will return to using Title 8 immigration authorities to expeditiously process and remove individuals who arrive at the U.S. border unlawfully. These decades-old authorities carry steep consequences for unlawful entry, including at least a five-year ban on reentry and potential criminal prosecution for repeated attempts to enter unlawfully.”

In response to calls for Alejandro Mayorkas to step down from his position as Secretary of Homeland Security over his management of the southern border, Representative Andy Biggs has announced that he will file articles of impeachment.

Representatives Lauren Boebert (R-Colo.) and Marjorie Taylor Greene (R-Ga.) were present and in support of this move.

During the Wednesday news conference, Biggs (R-Ariz.) said that Mayorkas had violated his oath of office.

“The founders said that you have impeachment for high crimes and misdemeanors — that’s constitutional,” Biggs said. “They didn’t say you have to be convicted of a felony. What they said is you have a public official who has violated public trust, and there is nobody who typifies that more in my opinion than Secretary Alejandro Mayorkas.”

Other Representatives, such as Pat Fallon (R-Texas), have also filed articles of impeachment against Mayorkas. Fallon said that he and Biggs will co-sponsor each other’s proposals. In Fallon’s articles, which were forwarded to the Judiciary Committee, Mayorkas was charged with “serious crimes and misdemeanors” while serving as the Secretary of Homeland Security.

Mayorkas responded to the threats during an interview with MSNBC on Tuesday.

“Within a broken system, we are doing everything that we can to increase its efficiency, to provide humanitarian relief when the law permits and to also deliver an enforcement consequence when the law dictates. That is exactly what we are doing. And as far as I am concerned, I will continue to do that with tremendous pride in the people with whom I work,” Mayorkas said.

In February 2021, Mayorkas secured his position as Homeland Security Secretary in a 56-43 vote, confirmed by the Senate.

The impeachment push comes as 2.3 million migrants were encountered in fiscal year 2022.
